Local rules

What’s different in St. Louis County.

Four things decide what you can build and what it costs: zoning, environmental protections, power for aerobic systems, and the ground itself. We publish each one only where we have checked it — and say so plainly where the answer is “same as the rest of Minnesota”.

Zoning & land use

St. Louis County's SSTS Ordinance 61 (adopted 2014, amended 2023) adds a sale-time rule of its own: a compliance inspection and Certificate of Compliance before a property transfers — and where the system fails, shows an imminent threat, or frozen ground blocks the inspection, closing requires an escrow of 100 percent of a licensed installer's written replacement estimate. The county permits countywide; MPCA's 2025 annual report lists no separate city or township program. Ask Planning and Zoning for the ordinance's other differences from the state rules.

Environmental protections

Nothing in St. Louis County changes this. Minnesota’s environmental floor is statewide: shoreland rules set septic setbacks from lakes and streams by water class (Minn. R. 6120.3400), and systems in shoreland or wellhead protection areas are held to the three-foot separation standard whatever their age (Minn. R. 7080.1500). A few designated river corridors add stricter district standards of their own.

Geology & soil

The dominant constraint here is seasonal soil saturation close to the surface (78.3% of rated soils), followed by organic (peat or muck) soil (31.5%). NRCS's Minnesota-specific ratings put 94.7% of rated ground in the very or extremely limited classes for a conventional below-grade trench and 78.5% for a mound -- where the trench is out, a mound is usually the design that works.
