Zoning & land use

Potter County's subdivision ordinance sets a hard floor for unsewered lots. Section 603.2 requires a minimum of one acre and 100 feet of width at the front building setback for any lot not served by public sewer, with a 40-foot front setback, and it lets the Planning Commission condition approval on a still larger lot where the sewage enforcement officer finds the soils will not take the effluent. The ordinance governs in every municipality without its own.

Environmental protections

Right Branch Big Nelson Run, East Fork Sinnemahoning Creek, UNT 24255 are carried on DEP's Chapter 93 drainage lists as Exceptional Value, and 31 further Potter entries are High Quality. A lot draining to one of them loses the § 71.51(b) planning exemption: the sewage module goes to the municipality and then to DEP, which is a second reviewer and a longer clock rather than a different septic system. Check your own stream on the drainage list before assuming the ordinary path.
