Denton County Public Health is the authorized agent for on-site sewage facilities, but its jurisdiction stops at the unincorporated county line. TCEQ’s registry lists eighteen more authorized agents inside Denton County, each running its own OSSF program for its own city or town: Denton, Flower Mound, the Denton County slice of Fort Worth, Argyle, Little Elm, Bartonville, Hickory Creek, Shady Shores, Krugerville, Krum, Double Oak, the Denton County slice of Frisco, Cross Roads, Oak Point, Ponder, Northlake, DISH and Copper Canyon. No other county this directory has covered splits its septic permitting this many ways.

The county’s own authorized-agent numbers reflect that split. TCEQ’s 2025 report counts 325 systems the county itself authorized for the unincorporated area: 293 of them surface irrigation, 30 drip, one standard trench, and one other. In 2024, it was close, with 331 authorized. Besides that, Flower Mound’s program authorized 40 in 2025, Oak Point 32, Krugerville 20, and the City of Denton 11: real volume, just filed with a different office depending on which side of a city line the lot sits on. A resident checking whether the county or their town runs the program should start with the Texas permit authority table.

For the unincorporated county’s own program, a new septic installation costs $310, and a repair costs $100, both payable to Denton County and both stated as non-refundable. The local rules sit in a Commissioners Court Order adopted October 16, 2007 and approved by TCEQ on December 28, 2007; the county does not post it on its own site, so TCEQ’s authorized-agent registry holds the public copy. Its Section 10 requires a permit for any single-family dwelling “regardless of acreage size,” sets a one-acre minimum for new single-family lots served by public water, two acres where the lot draws from a private well, with “environmental protection” to be demonstrated in flood hazard areas, and requires the application to be made in person. Site evaluations come only from a professional engineer or a registered sanitarian with a site-evaluator certification. A TCEQ-registered company maintains an aerobic system unless the owner qualifies under one of four routes the Order lists, the last of them a Class D wastewater license, and the maintenance report goes to the county three times a year either way; the county’s own testing form puts that at every four months. Conventional tank owners are told to plan on pumping every two to three years.

Soil is the main reason surface irrigation and drip dominate the permit record. Soil Data Access rates 74 of the 90 map units carrying a septic-absorption interpretation in the TX121 survey area as “Very limited,” with slow-percolation readings behind 72 of them and flooding behind another 12, on bottomland soils like Frio, Gowen, and Ovan along the Elm Fork and main-stem Trinity. Six of the named “Very limited” units are themselves soil-and-Urban-land complexes, Birome, Crockett, Justin, Lindale, Navo and Sanger paired with “Urban land” in the same map unit, evidence of how much of eastern Denton County NRCS had already mapped as built-over by the time of the survey. Denton County’s population reached 1,069,346 in the Census Bureau’s July 2025 estimate, up 23,120 in a year and 163,000 since its April 2020 base of 906,530, growth concentrated in the same cities that already run their own septic programs.

In the unincorporated county, septic permits come from Denton County Public Health, Environmental Health Division, 3900 Morse St., Denton. Inside Denton, Flower Mound, Little Elm, or any of the other fifteen towns and cities listed above, that city or town runs its own aerobic system and maintenance-contract program instead.

What’s different in Denton County.

Zoning & land use

Denton County issues the septic permit for the unincorporated county. It holds that job only because the commissioners court adopted an on-site sewage facility order and TCEQ approved it (Health and Safety Code § 366.031), and § 366.032(b) makes that order prevail wherever it is stricter than 30 TAC Chapter 285. Ask the office for its current order — Texas counties have no general zoning power, so the order, not zoning, is where a local siting rule sits.

Environmental protections

Nothing in Denton County changes this. Texas adds a separate approval path over the Edwards Aquifer recharge, transition and contributing zones, where TCEQ requires an Edwards Aquifer Protection Plan under 30 TAC Chapter 213. Elsewhere the Chapter 285 rules stand on their own.

Geology & soil

The dominant constraint here is clayey subsoil that water moves through too slowly (62.0% of rated soils), followed by bedrock close to the surface (21.3%). NRCS rates 78.3% of rated ground very limited for a standard soil absorption field, 23.9% for subsurface drip and 13.8% for surface application with disinfection. Where a conventional field will not pass, surface application is usually the route that does.
