The Delaware Public Health District's supplement sets vertical separation at eighteen inches with six inches of in-situ soil, and drops it to six inches where the effluent is pre-treated below 1,000 colony forming units per 100 millilitres. Operation permits then split by system type: mechanical, NPDES and all discharging systems expire annually on 31 January, gravity systems every five years, both renewing automatically where an inspection report has been filed and the fee paid.

On those parcels the off-lot discharging route is closed and the system has to be a soil-absorption design, whatever the lot looks like.

The dominant constraint here is water perching on a restrictive layer (36.5% of rated soils), followed by water standing on the surface (29.0%).
