Local rules

What’s different in Lehigh County.

Four things decide what you can build and what it costs: zoning, environmental protections, power for aerobic systems, and the ground itself. We publish each one only where we have checked it — and say so plainly where the answer is “same as the rest of Pennsylvania”.

Zoning & land use

Lehigh County updated its county subdivision ordinance in November 2025, and the Lehigh Valley Planning Commission administers it — but only in Slatington Borough, the one Lehigh County municipality without an ordinance of its own. It sets no lot-size floor: Section 444 sends any lot that cannot connect to public sewage to the Sewage Facilities Act, Chapter 73 and the municipal sewage enforcement officer. DEP's tabulation lists all 25 municipalities as running their own programme.

Environmental protections

Lehigh County has no Exceptional Value waters, but 6 entries on DEP's Chapter 93 drainage lists are High Quality — including Catasauqua Creek, Little Lehigh Creek, Tributaries to Jordan Creek. A lot draining to one loses the § 71.51(b) planning exemption, so the sewage module goes to the municipality and then to DEP. That is a second reviewer, not a different septic system. Check your own stream before assuming the ordinary path.

Geology & soil

The dominant constraint here is bedrock within 60 inches of the surface (39.6% of rated soils), followed by slow-percolating subsoil below 12 inches (35.3%). NRCS rates 66.3% of rated ground very limited for a conventional in-ground trench, 44.2% for a sand mound and 27.2% for drip irrigation -- where conventional is out, drip is often the system that works.
